Privacy Policy
Effective date: August 27, 2026
Modern Flash, LLC ("Modern Flash," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit [www.modernflashco.com](https://www.modernflashco.com), contact or book us, attend an event where we provide photo booth services, receive or access event photos, or otherwise interact with us (collectively, the "Services").
By using the Services, you acknowledge the practices described in this Privacy Policy. A separate event proposal, contract, release, or other agreement may provide additional terms for a particular event. If you access a third-party website or service through our Services, that third party's privacy policy also applies.
1. Personal Information We Collect
Depending on how you interact with us, we may collect the following categories of information.
Information you provide to us:
Contact and inquiry information, such as your name, email address, phone number, and the contents of messages you send through our website, email, phone, text message, social media, or other channels.
Event and booking information, such as event type, date and timeframe, venue or city, guest count, design direction, brand assets, inspiration, preferences, day-of contacts, and other details you choose to provide.
Contract and transaction information, such as proposals, agreements, invoices, payment status, billing details, and related records. Payment card and bank information is generally collected and processed by our payment service providers; we may receive limited transaction information but not complete payment credentials.
Communications and feedback, such as correspondence, reviews, testimonials, survey responses, and customer-support requests.
Information collected through photo booth and event services:
Event content, including photographs and, if included in the booked experience, videos, GIFs, boomerangs, guest messages, or other media created at an event.
Guest sharing information, such as an email address or mobile phone number that a guest voluntarily enters to receive event content by email or text message. AirDrop and QR-code sharing may operate without requiring Modern Flash to collect a guest's contact information, depending on the experience.
Corporate or sponsored-event information, which may include contact details voluntarily provided for lead capture, brand engagement, or follow-up, together with engagement data or aggregate post-event analytics. When we collect information on behalf of an event host or sponsor, we will use and disclose it as described at the event, in the applicable form, or in our agreement with that client. The host's or sponsor's privacy policy may also apply.
Information collected automatically:
When you use our website or related online services, we and our service providers may automatically collect information such as your IP address, browser and device type, operating system, referring page, pages viewed, approximate location derived from IP address, dates and times of visits, interactions with the site, and cookie or similar identifiers.
We collect this information through cookies, pixels, tags, scripts, local storage, and similar technologies. See Section 6 for more information.
Sources of personal information:
We may collect personal information directly from you; from the person or organization that books, hosts, or sponsors an event; automatically from your browser or device; from our service providers; and from publicly available sources or social media when you choose to interact with us there.
2. How We Use Personal Information
We may use personal information to:
respond to inquiries, prepare proposals, communicate about availability, and manage bookings;
provide, customize, and support our photo booth and event services, including designing overlays, coordinating setup, producing prints, delivering event content, and providing galleries;
send requested photos or other event content by email, text message, AirDrop, QR code, or another selected delivery method;
administer contracts, invoices, payments, accounting, and business records;
provide customer service and resolve technical or service issues;
operate, secure, maintain, analyze, and improve our website and Services;
measure website visits, inquiries, conversions, advertising performance, and service engagement;
prevent spam, fraud, abuse, and security incidents, including through Google reCAPTCHA;
send service-related communications and, where permitted, promotional communications;
create post-event analytics and carry out lead capture for corporate or sponsored events when disclosed to participants and authorized by the applicable client;
display reviews, testimonials, or event content as described in Section 5; and
comply with law, enforce our agreements, protect rights and safety, and establish or defend legal claims.
3. How We Disclose Personal Information
We may disclose personal information in the following circumstances:
Service providers. We use vendors that help us host and operate the website, manage inquiries and bookings, process payments, prevent spam, communicate with clients and guests, operate photo booths, process and store event content, create and host galleries, print photos, deliver emails or text messages, analyze activity, and measure advertising. These providers may include Squarespace, HoneyBook, payment processors such as Stripe when used, Google, and the providers of our booth, gallery, printing, email, and SMS tools.
Event clients, hosts, and sponsors. Event content and related gallery information may be provided to the person or organization that booked, hosted, or sponsored the event. For corporate or sponsored events, contact information and engagement information collected through a disclosed lead-capture experience may be provided to the applicable client or sponsor.
Other event participants and recipients. Depending on the event and gallery settings, photos or other event content may be viewable by the host, sponsor, guests, or anyone with access to the gallery or sharing link. Recipients may save, forward, post, or otherwise share content outside our control.
Professional advisers and legal authorities. We may disclose information to attorneys, accountants, insurers, auditors, law enforcement, courts, regulators, or other parties when reasonably necessary to comply with law, respond to legal process, protect rights or safety, investigate misconduct, or enforce our agreements.
Business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction.
At your direction or with your consent. We may disclose information when you ask us to do so or otherwise consent.
We do not sell personal information for money. However, certain uses of advertising cookies or similar technologies may be considered a "sale," "sharing," or "targeted advertising" under some privacy laws. See Sections 6 and 10 for available choices.
4. Event Galleries and Sharing
Clients may receive a gallery containing event photos. Gallery visibility and access depend on the booked service, the settings used for that event, and any agreement with the event client. Unless we expressly agree otherwise in writing, you should not assume that content created at an event is confidential or accessible only to the person pictured.
If you receive a gallery or sharing link, please use care before forwarding it. Modern Flash cannot control copies downloaded or shared by clients, guests, sponsors, or other recipients after delivery.
If you believe an image of you should be removed from a gallery controlled by Modern Flash, contact us using the information in Section 13. We will review the request, verify relevant details, and act as required by law and any applicable event agreement.
5. Portfolio, Testimonials, and Marketing Use
Unless the client opts out in writing, Modern Flash retains the right to use event photos, videos, reviews, testimonials, and other submitted or captured content on our website, in our portfolio, on social media, in advertising, and in other promotional materials, subject to applicable law and the terms of the event contract. The client is responsible for notifying Modern Flash of any privacy restrictions and for obtaining any notices, permissions, or releases required from event participants.
Clients who require a private event or do not want event content used for promotional purposes must notify us in writing before the event or within any opt-out period stated in the event contract. After receiving a valid opt-out, we will not use new event content from that event for promotional purposes. A later request concerning content already published will be reviewed in good faith, but removal may be limited by prior distributions, third-party reposting, applicable law, and any agreement or release that applies.
6. Cookies, Analytics, Advertising, and reCAPTCHA
Our Squarespace-hosted website uses cookies and similar technologies that are necessary for site operation and may use analytics and performance technologies to understand visits, traffic sources, interactions, and form or button conversions.
The website also uses Google Ads technology to measure advertising and conversions. Google and its partners may receive information such as your IP address, browser and device information, page URL, referrer, interactions, and cookie or advertising identifiers. Depending on your settings and applicable law, this information may be used to measure ads or personalize advertising.
Our forms use Google reCAPTCHA to help detect spam and abuse. reCAPTCHA may collect hardware and software information and interaction data and send it to Google for security and fraud-prevention purposes. Google's Privacy Policy and Terms of Service apply to reCAPTCHA and other Google services.
You can control cookies through your browser settings and, when available on our site, through our cookie-preference tools. Blocking cookies may affect site functionality or make analytics less accurate. You can manage Google advertising preferences through [Google's My Ad Center](https://myadcenter.google.com/) and may use industry opt-out tools such as [YourAdChoices](https://optout.aboutads.info/).
7. Email and Text Messages
We may use your email address or phone number to respond to an inquiry, coordinate an event, send proposals or service updates, deliver requested event content, provide support, or send other communications you have agreed to receive.
If you provide a mobile number through our inquiry or booking process, you consent to receive text messages from Modern Flash as disclosed at the point of collection. Message frequency varies. Message and data rates may apply. You may opt out of non-essential text messages at any time by replying STOP. For help, reply HELP or contact us using Section 13. Transactional or service-related messages may continue when necessary to fulfill a request or booking, subject to applicable law.
You may unsubscribe from marketing emails by using the unsubscribe link in the message or contacting us. Mobile opt-in information and consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. We may share mobile information with vendors that help us deliver messages and operate the Services.
8. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide Services, maintain business and tax records, honor opt-out requests, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods vary based on the type of information, the event agreement, provider settings, legal requirements, and operational needs.
Event galleries and media may remain available for the period communicated to the client or for as long as reasonably needed to provide the booked service. Clients and guests should download desired content promptly. Copies used in our portfolio or business records may be kept longer when permitted by the applicable agreement, release, consent, or law.
When information is no longer reasonably needed, we may delete, de-identify, or aggregate it. Backup copies may remain for a limited period until overwritten or deleted in the ordinary course.
9. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, wireless transmission, email, text message, gallery link, or storage system can be guaranteed completely secure. You use the Services and transmit information at your own risk.
10. Your Privacy Rights and Choices
Depending on where you live and subject to applicable exceptions, you may have the right to request access to, correction of, deletion of, or a copy of personal information we maintain about you; to withdraw consent; and to opt out of certain targeted advertising, sales, sharing, or marketing communications.
To make a request, email renee@modernflashco.com with the subject line Privacy Request and describe your request. We may need to verify your identity and authority before acting. If your information was collected on behalf of an event client or sponsor, we may direct the request to that organization or coordinate with it. We will not unlawfully discriminate against you for exercising a privacy right.
You can also manage cookies as described in Section 6 and communications as described in Section 7.
11. Children's Privacy
Our website and booking services are intended for a general audience and are not directed to children under 13. Children under 13 should not submit contact information through our website or use email or text delivery features without the involvement and consent of a parent or legal guardian.
Our booths may be used at weddings, birthdays, school functions, and other events where minors are present. Images of minors may therefore be captured and processed as part of an event arranged by an adult client or organization. The event client is responsible for providing appropriate notices and obtaining any permissions required for minors' participation and for the intended use of event content.
If you are a parent or legal guardian and believe a child under 13 has provided personal information directly to us without appropriate consent, contact us so we can review and, where required, delete it.
12. Third-Party Services and Links
Our website links to or works with third-party services, including HoneyBook and Instagram. Those services may collect information directly from you and process it under their own privacy policies and terms. We are not responsible for the privacy practices, security, or content of third-party services.
Personal information may be processed and stored in the United States or other countries where we or our service providers operate. Those locations may have different privacy laws than your place of residence.
